Terms & Conditions .

FlightHired Terms & Conditions

Welcome to FlightHired. These Terms & Conditions (the “Terms”) are a legal agreement between you and FlightHired LLC (“FlightHired,” “we,” “our,” or “us”). They govern your use of the FlightHired website, applications, and services (together, the “Platform”). By using the Platform or creating an account, you agree to these Terms and to our Privacy Policy. Please read them carefully.

1. Acceptance of Terms

By using FlightHired, you confirm that you are at least 18 years old and legally able to enter into a binding agreement. If you use the Platform on behalf of a company, you confirm that you are authorized to bind that company to these Terms. If you do not agree to these Terms, do not use the Platform.

2. Our Services

FlightHired is an aviation job board that connects aviation professionals (“candidates”) with aviation companies (“employers”). Our features include job listings, candidate profiles, the Crew Directory, Eligibility Match and Smart Screening, Salary & Hiring Trends, the Black Book employer directory, job alerts, messaging between candidates and employers, and, on request, help with writing a resume (Section 3.6).

2.1 A New and Evolving Platform

FlightHired is a new platform, and we improve it continuously. Its features, data, and pricing may change, and features may be interrupted or withdrawn. Price changes to an existing subscription always follow the notice rules in Section 8.3, and Section 8.4 describes the refund that applies if we withdraw a paid feature.

Features such as Eligibility Match, Smart Screening, Salary & Hiring Trends, the Black Book, job alerts, and messaging may contain errors, incomplete data, or incorrect matches. Do not rely on them as the only basis for any decision. Section 12 applies to every feature, paid or free. We welcome bug reports at contact@flighthired.com.

3. Important Disclaimers and User Responsibility

FlightHired is a platform that connects aviation professionals and employers. We do not employ candidates, act as a recruiter, or guarantee job placement or hiring outcomes. We review every listing before it is published (Section 4), but that review is an editorial check, not a verification. FlightHired does not verify or guarantee:

  • The accuracy or legitimacy of job listings
  • The identity or qualifications of employers, recruiters, or candidates
  • The outcome of any application or hiring process

Every interaction, communication, and decision made through the Platform, or as a result of using it, is at your own risk. You are responsible for verifying job opportunities and the legitimacy of employers, for doing your own due diligence, and for protecting your personal information.

3.1 No Guarantee of Employment

Creating an account, completing a profile, applying to a job, purchasing Pro Access or the Featured Candidate add-on, or using any other FlightHired feature does not guarantee an interview, a job offer, or employment of any kind. It does not guarantee that an employer will view, contact, or respond to you. Hiring decisions are made solely by employers. FlightHired has no control over, and makes no promises about, the number or type of jobs listed, the number of employers using the Platform, or the result of any application.

3.2 Featured Candidate and Other Visibility Features

Paid visibility features, such as Featured Candidate placement in the Crew Directory, change where your profile is displayed. Featured profiles appear before non-featured profiles in Crew Directory results; the order among featured profiles may change at any time and is not guaranteed. Visibility features do not guarantee that any particular employer will see your profile, that you will receive more views, messages, or interviews, or that you will be hired. Placement depends on the search filters employers choose and on the number of other featured profiles. Employers remain free to contact any candidate, featured or not. A visibility feature is not an endorsement, a ranking of merit, or a verification of your qualifications.

3.3 Eligibility Match and Smart Screening

Eligibility Match shows candidates how their profile compares with the requirements of a job, using labels such as “Qualified,” “Almost there,” and “Reach.” It is an informational tool. Smart Screening goes further: an employer can set minimum requirements for a listing, for example total flight time or a certificate, and when a listing has a gated requirement that your profile does not meet, the Platform does not submit your application.

Both tools work only from the information candidates and employers have entered, which may be incomplete, out of date, or wrong, and both may contain errors. A match label is not a job offer, an invitation to apply, or a hiring decision. A Smart Screening block is a decision by the employer, not by FlightHired. Employers set their own requirements and are solely responsible for making sure those requirements are lawful and non-discriminatory in every place where they hire.

When a Smart Screening requirement is not met, the Platform tells you which requirement it is. You can update your profile at any time and apply once the requirement is met. If you believe a requirement is wrong, that you meet it on another basis, or that you need an exception or accommodation, email contact@flighthired.com with the listing link. We will pass your request to the employer, who decides, and we will tell you the outcome; if the employer does not respond within 14 days, we will tell you that too. If the block was caused by an error on the Platform rather than by the employer’s requirement, we will correct it and let you apply. You may also contact the employer through any external application link or contact shown on the listing.

FlightHired is not liable for any opportunity missed, application blocked, or decision made because of a match result.

3.4 Salary & Hiring Trends

Salary & Hiring Trends shows figures compiled from job postings on the Platform. They are aggregated from what employers published, not from surveys or payroll data, and some values are estimates labeled as such. They may not reflect what any employer will offer or what any candidate will receive. The information is provided for general interest only and is not financial, career, or legal advice.

3.5 The Black Book Employer Directory

The Black Book is a directory of aviation companies compiled from public sources and user submissions. A company’s inclusion is not an endorsement, a statement that the company is hiring, or a confirmation that the company is affiliated with FlightHired. Company details such as bases, fleets, contacts, and careers links may be incomplete or out of date. Companies and individuals may request a correction or removal under Section 11.

3.6 Resume Writing Help

On request, FlightHired helps candidates rewrite or rebuild a resume. Sometimes this is free; sometimes there is a fee, which we quote and agree with you before any work starts. When you ask for this help, the following applies.

We use AI writing tools. We produce the draft with artificial intelligence writing tools from providers such as OpenAI (ChatGPT) and Anthropic (Claude), together with review by our staff. The resume, notes, and other material you send us are entered into those providers’ services for that purpose. The providers handle that material under their own terms of service and privacy policies, which may allow them to keep it and use it to improve their models. Our Privacy Policy explains this and what to leave out before you send anything. If you do not want your resume processed this way, do not request the service.

The draft is a starting point, and you are responsible for it. You must review the draft, confirm that every statement in it is true and accurate (flight hours, ratings, certificates, employers, dates, and everything else), and decide what to use. Do not send a resume to any employer with a detail you have not checked. We are not responsible for errors in a resume you chose to use.

No guarantee of results. A rewritten resume does not guarantee an interview, an offer, a response from any employer, or any particular result from an applicant tracking system. Section 3.1 applies.

Your content stays yours. You keep ownership of the resume you send us and of the draft we return. You confirm that you have the right to share everything you send us and that it contains no information about another person that you are not entitled to share.

Fees. Where a fee applies, it pays for the work of producing the draft and is earned when the draft is delivered. It is not refundable because of the outcome of a job search or because you decide not to use the draft. Section 8.4 does not apply to resume help fees.

A writing service, not advice. Resume help is a writing service. It is not career, legal, immigration, or employment advice, and Section 12 applies to it.

4. Third-Party Listings, External Applications, and Direct Contact

Where our listings come from. FlightHired works directly with some employers, who post and manage their own listings. Many other listings are sourced from publicly available postings on company career pages and similar public sources, and are published with a link or a contact for applying directly. We review each listing before it is published. That review is an editorial check that the listing appears to be a genuine pilot or crew position; it is not a verification of the employer, the contact person, or the terms of the job. We are not told when a position is filled, withdrawn, or changed, and companies do not always take old postings down, so we cannot guarantee that every listing is current, accurate, or still open. Before you apply, confirm with the employer that the position is still open, that the details are accurate, and that you meet all stated minimums and requirements.

Listings sourced from third-party websites, company career pages, recruiter communications, or publicly available postings are published with one of the following:

  • A link to an external website where applications are submitted; or
  • Contact information, such as an email address, for applying directly to the employer or its representative

FlightHired does not host, process, or manage applications for these listings and does not take part in any hiring or recruiting activity. FlightHired does not control third-party job postings, external application systems, or communications; does not verify the identity, legitimacy, or authorization of any employer, recruiter, or contact person; does not guarantee the accuracy, completeness, or timeliness of any listing or contact information; and does not represent that any listing is authorized by or affiliated with the originating company.

When you leave the Platform or contact a third party, you do so at your own risk. FlightHired is not responsible for external website content or availability, for your communications with employers, recruiters, or other third parties, for misuse of contact information, for application outcomes or hiring decisions, or for any damage or loss that results from a third-party interaction. You are responsible for verifying the legitimacy of job opportunities and contacts and for doing your own due diligence.

All company names, trademarks, and logos belong to their respective owners and are used for identification only. Their appearance on the Platform does not imply endorsement, partnership, or affiliation with FlightHired. FlightHired may remove any job listing or contact information at any time, including at the request of the originating company or rights holder.

5. User Accounts

5.1 Account Information

You agree to provide accurate, current, and complete information when you create an account, and to keep it up to date. You may hold one candidate account and, if you hire for a company, one employer account. You may not create additional accounts to get around a suspension, a package limit, or any other rule.

5.2 Account Security

You are responsible for keeping your login details confidential and for everything that happens under your account. You may not share your login or let another person or organization use your account, your Pro Access, or your employer package. If you believe your account has been used without your permission, tell us at once at contact@flighthired.com.

5.3 Employer Accounts

The person who creates an employer account confirms that they are authorized to post jobs and act on behalf of the company named on the account. Company profiles, logos, and descriptions must belong to that company or be used with its permission. FlightHired may ask for proof of authorization and may suspend or remove unverified employer accounts and their listings. An employer that downloads or saves candidate information, for example a CV received with an application, is responsible for that copy under applicable privacy and employment laws, including honoring deletion requests from the candidate.

5.4 Suspension and Termination by FlightHired

FlightHired may suspend or terminate an account that violates these Terms or that we consider harmful to the Platform or its users, with or without notice. See Section 16.

5.5 Closing Your Account

You may close your account at any time by emailing contact@flighthired.com from the email address on the account, or from Settings where that option is offered, and we will close it promptly. Closing your account cancels every subscription and add-on on the account (for example Pro Access and Featured Candidate) and stops their renewals. No refund is due for the current period (Section 8.4). If a renewal is charged after we receive a valid closure request but before we process it, we will refund that charge. Applications you have already sent remain with the employers who received them. Our Privacy Policy explains what we keep after an account is closed.

6. Job Listings and Applications

Employers are solely responsible for the accuracy, legality, and content of their job postings. Candidates are responsible for the accuracy and completeness of their applications, qualifications, and credentials. FlightHired does not run background checks and does not independently verify the credentials, identity, or legitimacy of employers, candidates, or recruiters. Smart Screening (Section 3.3) only compares the information a candidate entered with the requirements an employer set; it is not verification.

6.1 Employer Posting Standards

Every job listing on FlightHired must be for a genuine, currently open position with the employer or its authorized representative. A staffing agency or recruiter acting as the authorized representative of a named employer may post that employer’s positions in the employer’s name; it may not use the Platform to build its own candidate lists (see Sections 6.4 and 10). Employers may not post:

  • Listings that charge the candidate. Any position where a candidate must pay the employer, a recruiter, or a third party in order to apply, to have an application “processed” or “forwarded,” to be interviewed, to be placed, or to obtain or keep the position. Application fees, processing fees, placement fees, “security deposits,” and similar charges are prohibited.
  • Pay-to-fly positions. Any position where the pilot pays for the flight hours, line training, or type rating that the position consists of, so that the “job” is in substance a purchase of flight time. Genuine employment where the employer pays for required training is allowed, including positions with a training agreement, training bond, or promissory note under which the pilot repays training costs only if they leave within an agreed period, where such agreements are lawful in the place of employment.
  • Disguised sales. Multi-level marketing, commission-only “opportunities” presented as pilot jobs, or roles whose real purpose is to sell a course, a membership, or a product.
  • Unlawful or discriminatory listings. Listings that discriminate on any basis prohibited by applicable law, or that are unlawful in the country where the job is located.
  • Copied, duplicate, or expired listings. Listings copied from another employer without authorization, duplicate listings for the same role, or roles that are no longer open. Reposting or renewing a genuine open role through the Platform’s own repost feature is not a duplicate.

FlightHired may remove any listing that breaks these standards, refuse future listings, and close the employer’s account, without refund.

6.2 Candidate Accuracy

Flight hours, certificates, ratings, type ratings, medical status, visa or work authorization, employment history, and everything else you enter on your profile or send with an application must be true and current. Employers rely on this information and are responsible for verifying it; FlightHired does not. Deliberately entering false hours, certificates, or credentials is a breach of these Terms and will result in closure of your account. If you notice an honest mistake, correct it as soon as you can.

6.3 Reporting Job Listings

You can report a job listing that appears inaccurate, outdated, fraudulent, fee-charging, or otherwise in breach of these Terms. FlightHired may, but is not obliged to, investigate and remove any listing or user at its sole discretion.

6.4 Messaging

Messaging on FlightHired is for hiring-related communication between candidates and employers. You may not use it to send unsolicited advertising, to sell products or services, to recruit for any company other than the employer named on your account (an agency authorized under Section 6.1 may message for the employer it represents), to request payment from a candidate, to harass anyone, or to harvest contact details for marketing, resale, or recruiting unrelated to the employer’s own openings. Exchanging a phone number or email address to arrange an interview or to continue a genuine hiring conversation is of course allowed. We may review messages to detect fraud, spam, and abuse, and we may suspend messaging for accounts that misuse it.

7. Prohibited Activities

You agree not to:

  • Post false, misleading, or fraudulent job listings or information
  • Post or promote positions that charge candidates a fee, or pay-to-fly positions (Section 6.1)
  • Share content that is unlawful, offensive, discriminatory, or harmful
  • Use the Platform to spam, harass, solicit, or defraud other users
  • Attempt to gain unauthorized access to the Platform or to other users’ accounts
  • Scrape, harvest, or copy Platform Data in bulk, or use bots, scripts, or AI tools to access the Platform (Section 10)
  • Share your login, or sell, rent, or transfer your account or package to anyone else
  • Request or share sensitive personal information (such as Social Security numbers, financial information, or identification documents) outside a legitimate and secure hiring process
  • Interfere with the operation or security of the Platform, or upload malicious code
  • Enter any candidate’s personal information (name, contact details, resume content, or profile details) into the job description writing tool, which is for job details only

FlightHired may remove, edit, or restrict any content, job listing, or user account at any time, with or without notice, at its sole discretion.

8. Payments and Subscriptions

8.1 Plans

Candidate Basic is free. Employer Basic is free and allows one live job listing at a time. Pro Access for candidates and Pro Access for employers are paid monthly subscriptions. Featured Candidate is a paid monthly add-on, available to candidates on Basic or Pro Access, and is billed and cancelled separately from the plan. One-time purchases may be offered in the future. Current prices and what each plan includes are shown on the pricing page and at checkout. Some features of the Platform are only available on a paid plan.

8.2 Recurring Billing Authorization

By purchasing a subscription, you authorize a recurring charge to your chosen payment method at the price shown at checkout, plus any applicable taxes, until you cancel.

Who you buy from. Paid subscriptions are sold and billed by “Sold through Link, LLC”, the Stripe entity that provides the merchant-of-record service (“Link”). Link acts as the merchant of record for the transaction, collects applicable taxes, and issues your receipts and invoices. The purchase terms Link presents at checkout also apply to your payment. FlightHired provides the service; Link handles the payment.

8.3 Automatic Renewal

Subscriptions renew automatically each month at the end of the billing period, at the then-current price, until you cancel. We send a reminder email at least 7 days before each renewal. If the price of your plan changes, we will email you clear notice no less than 7 days and no more than 30 days before the new price takes effect, with instructions for cancelling. The new price applies only to renewals after that date.

8.4 Cancellation and Refunds

How to cancel. You can cancel at any time from My Packages (candidates) or My Package (employers): click Cancel, then Confirm. No call or email is needed. Cancelling stops the next renewal. You keep full access to the paid features until the end of the billing period you have already paid for; after that, your account returns to the free Basic plan and nothing is deleted. Add-ons such as Featured Candidate are separate subscriptions. Cancel them separately in the same place; cancelling your plan does not by itself cancel an add-on. If you resume a cancelled plan or subscribe again, you authorize new recurring charges under Section 8.2 from that date.

Refunds. Because you can cancel at any time and keep what you paid for until the period ends, payments are non-refundable. We do not give refunds or credits for partial billing periods, unused time, features you did not use, or renewals you forgot to cancel. A one-time purchase is non-refundable once the feature has been activated. The only exceptions are: (a) where a refund is required by the law of your state or country; (b) a duplicate charge, or a charge we made in error; (c) where we permanently discontinue or materially reduce a paid feature, in which case we refund the unused part of any prepaid period for that feature; and (d) a refund that Link, as merchant of record, decides to issue under its own policies.

Our cancellation of your plan. If we close your account for a breach of these Terms, no refund is due. If we close your account or end your paid plan for any reason other than your breach (for example, because we discontinue a service or close the Platform), we will refund the unused part of the period you paid for.

8.5 Payment Processing and Failed Payments

Payments are processed by Stripe. We do not store your full card number. If a renewal payment fails, we will retry it for up to two weeks and email you to update your payment method. If payment still fails, your subscription is cancelled and your plan returns to Basic; you can subscribe again at any time. Refunds, where one is due under Section 8.4, are issued through our payment provider and appear on your receipt and in your account as refunded.

8.6 Chargebacks and Billing Disputes

If you believe a charge is wrong, we ask that you contact contact@flighthired.com first; most billing problems can be fixed the same day. This is a request, not a condition of exercising your rights with your bank or card issuer.

When you dispute a charge with your bank or card issuer, the payment is taken back from us and held until the dispute is decided. While a dispute is open we may suspend the paid features that the disputed payment covers, and we may cancel the subscription, without proration. We may also suspend an account while a dispute that appears fraudulent is investigated.

If the dispute is resolved in your favor, or we agree the charge was wrong, we will at your choice refund any amount still owed (net of any amount your bank has already returned to you) or restore your access for the period you paid for. If the dispute is resolved in our favor and the payment stands, you receive the full amount of paid time you lost during the suspension, either as an extension of your subscription by that many days or, if the subscription has ended, as a credit for that many days which you can use without making another purchase.

8.7 Taxes

Prices are shown in U.S. dollars and, unless stated otherwise at checkout, exclude taxes. Sales tax, use tax, VAT, GST, or a similar tax is calculated, added at checkout, and shown on your receipt by Link as merchant of record, based on the billing address and country you provide; you are responsible for keeping that information accurate. You are responsible for any other tax, duty, or levy that applies to your purchase or to your use of the Platform, including any tax your state or country requires you to self-assess, and for any tax on income you receive from employment found through FlightHired. FlightHired does not provide tax advice. Employers are solely responsible for all employment, payroll, and withholding taxes for the people they hire.

8.8 Pricing and Service Changes

FlightHired may change its prices, plans, and features at any time. Price changes take effect only after the notice described in Section 8.3. We may modify or discontinue any feature or service at any time; Section 8.4 describes the refund that applies if a paid feature is discontinued.

9. Intellectual Property

9.1 FlightHired Content

All content, software, design, trademarks, branding, data compilations, and other materials on FlightHired are owned by or licensed to us and are protected by copyright, trademark, trade secret, and other laws. You may not copy, modify, distribute, sell, or create derivative works from them except as these Terms expressly allow. To the fullest extent permitted by law, FlightHired content and Platform Data (Section 10) are reserved from any text and data mining, AI training, or machine-learning use. Our pages carry machine-readable “noai” and “noimageai” signals; ignoring them is a breach of these Terms.

AI-generated content. Some of our own content, including images, captions, and text in our social media posts, advertisements, articles, and on the Platform, is created or edited with artificial intelligence tools from various providers. Such images and text are illustrative. They do not depict real people, aircraft, companies, or events unless we say so, and any resemblance is unintended. This content is FlightHired content under this Section 9.1.

9.2 User Content

You keep ownership of the content you submit to FlightHired: profiles, resumes, photos, messages, job listings, company descriptions, and other material (together, “User Content”).

Candidate content. By submitting a profile, resume, photo, application, or message, you grant FlightHired a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format, and transmit that content, only as needed to operate the features you use: showing your profile to employers in the Crew Directory, delivering your application and chosen CV to the employer you applied to, carrying your messages, running Eligibility Match and job alerts, and keeping backups. We will never sell your resume or profile, and we will not use your name, photo, resume, or messages in advertising or marketing without your separate written permission.

Employer content. By submitting a job listing, company profile, logo, or description, you grant FlightHired a non-exclusive, worldwide, royalty-free license to host, reproduce, display, format, transmit, and promote that content on the Platform and in FlightHired marketing, for example by sharing a job listing on social media or in a job alert email.

Each license ends when you delete the content or close your account, except (a) for copies kept in routine backups for a limited time, (b) for applications and messages already delivered to another user, who keeps their copy, (c) for aggregated, non-identifying statistics, and (d) for employer content already included in a FlightHired marketing post or email before deletion, which we will not reuse but need not retract. You confirm that you have the rights needed to grant these licenses and that your User Content does not infringe anyone else’s rights or break any law.

9.3 Crew Directory Visibility

By creating a candidate profile you agree that it is shown to employers with Crew Directory access, who may view it, view and download the CV you have uploaded, and contact you through the Platform. Our Privacy Policy lists exactly what employers see. Every employer with Crew Directory access has created an employer account and accepted these Terms, which prohibit copying, harvesting, or sharing candidate profiles (Section 10). Being listed in the Crew Directory is a core part of the service, and profiles cannot be hidden individually. If you no longer want to be listed, you can close your account (Section 5.5) and your profile is removed.

9.4 Feedback

If you send us ideas, suggestions, or feedback about the Platform, we may use them without any obligation to you.

10. Platform Data, Automated Access, and the Black Book

10.1 What Is Protected

The Black Book employer directory, job listings, the Crew Directory, Salary & Hiring Trends data, company descriptions, fleet data, contact and careers links, and every other data set, compilation, or page on FlightHired (together, “Platform Data”) were researched, selected, arranged, and written at substantial expense. FlightHired owns the compilation, the selection and arrangement of the data, the descriptions and other original text, and the software and structure of the Platform. It protects the Platform Data through these Terms and, for the Black Book, the Crew Directory, Salary & Hiring Trends, and the full details of newer listings, through account login as well. Individual public facts, for example that a company exists or operates a particular aircraft, are not owned by anyone; what these Terms restrict is taking them from FlightHired. Access to Platform Data is licensed to you only for the purposes in Section 10.2, through the normal pages of the website.

10.2 What You May Do

Using the Platform normally is of course allowed. You may:

  • View, search, and save job listings and Black Book entries for your own job search or your own direct hiring
  • Apply to jobs, message other users through the Platform, and follow links to an employer’s own website
  • As an employer, view candidate profiles one at a time and view or download a CV that a candidate has made available on their profile or sent you with an application, for your own direct hiring only
  • Print or save a single page or listing for your own personal, non-commercial reference
  • Use assistive technology, such as a screen reader, to access the Platform

10.3 Prohibited Use of Platform Data

You may not, and may not help anyone else to:

  • Copy, download, extract, scrape, crawl, index, mirror, or harvest Platform Data in bulk or systematically, whether manually or with any automated tool, script, bot, browser extension, headless browser, or AI agent
  • Use any artificial intelligence, machine learning, or language model tool to read, parse, summarize, extract, or collect Platform Data from the Platform, or use Platform Data to train, fine-tune, or evaluate any such model (assistive technology used by an individual under Section 10.2 is not affected)
  • Access FlightHired through any means other than the public web pages we provide, including our internal API endpoints, or get around any login, nonce, rate limit, pagination limit, or other access control
  • Build, sell, license, or share any list, database, directory, lead list, mailing list, or data product that contains Platform Data, including employer names, contacts, careers links, fleet data, candidate profiles, or salary data
  • Contact employers or candidates found on FlightHired in bulk, or on behalf of a recruiting firm, staffing agency, or data vendor (an agency posting a named employer’s jobs under Section 6.1 is not affected)
  • Share your login or let another person or organization use your Pro Access or employer account

10.4 Consequences

If we reasonably believe you have breached Section 10.3, we may immediately suspend or close your account and any related accounts, cancel subscriptions without refund, block your access, and demand the return or destruction of all copied data.

Liquidated damages for extraction. An “Extraction Breach” means (a) the automated, bulk, or systematic copying of Platform Data, (b) the circumvention of an access control to obtain Platform Data, or (c) the use of more than one record of Platform Data in a commercial product, list, or service, in each case in breach of Section 10.3. Activities permitted by Section 10.2 are never an Extraction Breach or a breach of these Terms. Copying or using a single record outside Section 10.2 breaches these Terms but is not an Extraction Breach. A connected series of extraction acts by the same person or organization, or by people acting together, within any 12-month period counts as one Extraction Breach, and the per-record amount applies to the total number of records taken in that series.

The harm from an Extraction Breach is real but difficult to measure: lost subscription revenue, the cost of investigating and remediating the breach, re-seeding and re-verifying the affected data, and the loss of exclusivity in a data set built over years. You therefore agree that FlightHired may recover, as liquidated damages and not as a penalty, US $25 for each company record, job record, or candidate record copied, extracted, or used in an Extraction Breach, with a minimum of US $10,000 for each Extraction Breach, which the parties agree is a reasonable estimate of FlightHired’s minimum loss. FlightHired will not recover liquidated damages twice for the same records, and will not recover both liquidated damages and actual damages for the same loss. These amounts are in addition to injunctive relief, FlightHired’s attorney fees and costs, and any other remedy available under applicable law, which may include the Computer Fraud and Abuse Act, the Digital Millennium Copyright Act, the Defend Trade Secrets Act, and Arizona law (including A.R.S. § 13-2316). You agree that an Extraction Breach causes irreparable harm for which an injunction is an appropriate remedy, and that FlightHired may seek that injunction in any court of competent jurisdiction notwithstanding Section 17.

10.5 Monitoring and Seeded Records

We log access to Platform Data and use technical measures, including rate limits, access tokens, and seeded or watermarked records, to detect copying. Seeded records are fictitious company entries placed only in the Black Book; they are never published as job listings or candidate profiles and never carry a real person’s contact details. Seeded records are protected the same as real records. Their appearance in any list, database, or communication outside FlightHired is evidence of an Extraction Breach, which we will investigate before taking action under Section 10.4.

11. Copyright Complaints and Removal Requests

11.1 Copyright Infringement Notices (DMCA)

FlightHired respects the intellectual property of others and responds to notices of claimed copyright infringement under the Digital Millennium Copyright Act. Our designated agent is registered with the U.S. Copyright Office (registration DMCA-1081917). If you believe content on the Platform infringes your copyright, send a written notice to our designated agent: FlightHired LLC, Attn: Copyright Agent, 16211 N. Scottsdale Rd, PMB 242, Scottsdale, AZ 85254, telephone (602) 688-2617, contact@flighthired.com.

Your notice must include: (a) identification of the copyrighted work; (b) the URL or other location of the material you want removed; (c) your name, address, telephone number, and email address; (d) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; (e) a statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act for the owner; and (f) your physical or electronic signature. On receipt of a valid notice we will remove or disable access to the material expeditiously and notify the user who posted it.

11.2 Counter-Notices

If your content was removed and you believe the removal was a mistake or a misidentification, you may send a counter-notice to the same address. It must contain: (a) identification of the removed material and its former location; (b) a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification; (c) your name, address, and telephone number; (d) a statement that you consent to the jurisdiction of the federal court for the district where you live (or, if outside the United States, the District of Arizona) and that you will accept service from the person who sent the original notice; and (e) your signature.

We will promptly forward a valid counter-notice to the person who sent the original notice. We will restore the material between 10 and 14 business days after our designated agent receives your valid counter-notice, unless our designated agent first receives notice from that person that they have filed a court action seeking an order to restrain you from the allegedly infringing activity. We may still remove content on grounds independent of the copyright claim, such as a breach of these Terms.

11.3 Repeat Infringers

We close the accounts of users who repeatedly infringe the copyrights of others.

11.4 Company Correction and Removal Requests

A company that wants a job listing or a Black Book entry corrected or removed, or an individual named in an entry, may email contact@flighthired.com with the page link and the change requested. We aim to respond within 10 business days, and we may modify, restrict, or remove content while we review a request, subject to applicable law.

12. Limitation of Liability and Disclaimer of Warranties

To the fullest extent permitted by law, FlightHired provides the Platform on an “as is” and “as available” basis and disclaims all warranties, express or implied, including fitness for a particular purpose, merchantability, non-infringement, and the accuracy, completeness, or reliability of content.

FlightHired does not guarantee that the Platform will be uninterrupted, secure, or error-free; that job postings are legitimate, accurate, or current after our editorial review at publication (Section 4); that employers, recruiters, or candidates will meet expectations or qualifications; or that any match result, salary figure, or directory entry is accurate.

To the fullest extent permitted by applicable law, FlightHired is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of employment opportunities, loss of income or revenue, loss of data, business interruption, or reputational harm, arising out of or related to your use of or inability to use the Platform; third-party listings or external websites; communications or interactions with other users or third parties; any content posted on the Platform; or any match, screening, salary, or directory information provided by the Platform.

In no event will FlightHired’s total liability for all claims arising out of or related to the Platform exceed the greater of (a) the amount you paid for FlightHired subscriptions and add-ons in the 12 months before the claim arose, or (b) US $100. Some states do not allow the exclusion of certain warranties or damages, so some of the above may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless FlightHired, its owners, employees, affiliates, and partners from any third-party claims, damages, liabilities, losses, and expenses (including reasonable legal fees) to the extent they arise out of: your breach of these Terms or of any applicable law; User Content you submit that infringes or misappropriates another person’s rights; for employers, any claim by a candidate or a government agency relating to your job listings, your screening requirements, or your hiring decisions; or your fraudulent, unlawful, or intentionally harmful conduct on or through the Platform.

This indemnity does not apply to the extent a claim results from FlightHired’s own breach of these Terms, negligence, or willful misconduct. FlightHired will notify you promptly of any claim, allow you to control the defense with counsel reasonably acceptable to us, and cooperate at your expense. You may not settle any claim that imposes an obligation on FlightHired or admits fault on its behalf without our written consent.

14. No Agency or Employment Relationship

FlightHired is an independent platform. It is not an employer, recruiter, hiring agent, or staffing agency. Nothing in these Terms creates an agency, partnership, joint venture, or employment relationship between FlightHired and any user. Every employment relationship is solely between the candidate and the employer.

15. Privacy

Your use of FlightHired is governed by our Privacy Policy, which explains what information we collect, how we use it, and the choices you have. It also explains that we use AI writing tools from providers such as OpenAI and Anthropic for resume help you request and to draft or check the messages we exchange with you, and what to leave out of anything you send us.

16. Termination

We may suspend or terminate your access to the Platform, or to any part of it, at any time if you breach these Terms, if the law requires it, or if your conduct harms the Platform or other users. We will normally tell you why.

Our automated security systems (described in our Privacy Policy) may also flag unusual activity and temporarily restrict access to certain features or accounts while we look into it. A temporary automated restriction is not a finding that you breached these Terms. If you believe you were restricted in error, email contact@flighthired.com and a member of our staff will review it.

If we close your account for a confirmed breach, no refund is due and you may not create a new account. Sections 3, 4, 9, 10, 11, 12, 13, 14, 15, 17, and 18 survive termination.

17. Governing Law and Dispute Resolution

17.1 Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law rules.

17.2 Talk to Us First

Before starting any formal dispute, you agree to email contact@flighthired.com with a description of the problem and give us 30 days to resolve it with you.

17.3 Binding Arbitration

If we cannot resolve the dispute within 30 days, any dispute, claim, or controversy arising out of or relating to these Terms or the Platform will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules (or its Commercial Rules for employer accounts). The seat of arbitration is Maricopa County, Arizona; hearings may be held by video. For claims by an individual consumer, FlightHired will pay the arbitration filing and arbitrator fees above what you would have paid to file in court. The arbitrator’s decision is final and may be entered as a judgment in any court.

17.4 Exceptions

Either party may bring an individual claim in small-claims court. FlightHired may seek an injunction or other urgent relief in any court of competent jurisdiction to stop unauthorized access to or copying of Platform Data (Section 10) or infringement of its intellectual property.

17.5 Class Action Waiver

You and FlightHired agree that disputes will be resolved only on an individual basis, and not as a plaintiff or class member in any class, consolidated, or representative action. If this waiver is found unenforceable for a particular claim, that claim proceeds in court, not in arbitration.

17.6 Opt-Out

You may opt out of arbitration by emailing contact@flighthired.com with the subject “Arbitration opt-out” within 30 days of first accepting these Terms. If you opt out, disputes will be heard by the state or federal courts in Maricopa County, Arizona, and you consent to their jurisdiction.

18. General

  • Entire agreement. These Terms, the Privacy Policy, the prices and plan details shown at checkout, and the purchase terms presented by Link at checkout (which govern the payment itself) are the entire agreement between you and FlightHired about the Platform.
  • Severability. If any part of these Terms is found unenforceable, the rest remains in effect.
  • No waiver. If we do not enforce a part of these Terms, we may still enforce it later.
  • Assignment. You may not transfer your account or these Terms to anyone else. FlightHired may assign these Terms to an affiliate or to a successor in a merger, acquisition, or sale of assets.
  • Force majeure. FlightHired is not liable for delays or failures caused by events outside our reasonable control, including outages at hosting, payment, or email providers.
  • Notices. We may give you notice by email to the address on your account or by posting on the Platform; email counts as written notice. Notices to FlightHired go to contact@flighthired.com.
  • Sanctions and export laws. You may not use the Platform if you are located in, or are a resident of, a country or territory subject to comprehensive U.S. sanctions, or if you are on a U.S. government restricted-party list.
  • Headings. Section headings are for convenience only.

19. Changes to Terms

FlightHired may update these Terms at any time. We will post the updated Terms on this page with a new “Last Updated” date and, for material changes, email account holders at least 14 days before the changes take effect. Changes that are required by law, or that are needed to protect the security of the Platform or its users, may take effect immediately, and we will notify you as soon as practicable. Continued use of the Platform after the effective date constitutes acceptance. If you do not agree, close your account before the changes take effect.
